The South African Government receives an immoral income from our fear of crime and criminal activity, and every time a criminal act is committed. How?

The security industry in SA is a billion Rand industry. For every (after-tax) Rand that fearful South Africans spend to protect themselves and their property, the SA Government collects 14% VAT. (In Gauteng: 2 million households pay +/- R240 per month for the services of armed response (not crime prevention!!). Let us calculate: 2 million x R240 x 12 months x 14% VAT = R,00 (Eight Hundred and Six Million Four Hundred Thousand Rand from 1 province out of 9)) And if one becomes a victim of crime, and spend more money to repair the mental or physical damages, or replace lost goods, the Government collects VAT again on every such transaction, i.e. When replacing a stolen vehicle at R300 000,00 government receives a whopping R42 000,00 in VAT, and that after you have paid VAT on your initial purchase!! If you die as a result of crime, Government receives Estate Duties and Death Taxes from your estate after the very same Government has failed to protect your rights as specified in our Constitution.

Ever wondered what Government’s “income” in Estate Duties and Death Taxes was as a direct result of  1782 farmers murdered since 1994? And the transfer fees on the “forced” sale of farms after the owner was murdered?

STAND and PRIORA FORUM invite all South Africans to become part of a national effort the motivate Government to suspend this immoral “income” as a direct result of crime. Since the Government constantly request that South African citizens make crime “non-profitable” for the criminals by not dealing in stolen goods, Government should lead by example and alleviates the financial burden on the citizens of South Africa as a direct result of crime and criminal activity by making all expenses towards self protection and preservation tax deductible, treat all such expenses at 0% VAT, and if one dies as the result of a criminal activity, exempt such an estate from all Estate Duties and Death Taxes in order for your loved ones to carry on with their lives without the additional stress of financial survival as well.

Project 10 000 x 100 aims to motivate Government by any legal means possible as follows:

* To make all expenses towards self-protection and preservation tax deductible, even for the salaried person.

Example: Insurance premiums, electric fencing, burglar proofing, alarm systems, Movement-sensors, satellite-tracking devices, armed response contributions, Guards and patrols, etc.

* To rate all expenses towards self-protection and preservation at 0% VAT.

Example: Insurance premiums, electric fencing, burglar proofing, alarm systems, Movement-sensors, satellite-tracking devices, armed response contributions, Guards and patrols, etc.

* To rate all expenses to address the damages of crimes suffered at 0% VAT.

Example: Damage to property, damage to vehicles, replacement of stolen items, trauma counselling for victims, medical expenses in the case of injury, funeral costs in the event of death, legal expenses, etc.

And  

* To exempt any person’s Estate from Death Taxes and Estate Duties, if such person has died as a result of a criminal activity

Example:  armed robbery,  car hi-jacking, rape or farm-murder, etc.

PRIORA FORUM and STAND are in the preparatory phase of a constitutional hearing/action to determine whether it is constitutional and/or moral for a Government to gain financially from a situation that has a clear negative impact on the majority of the citizens of South Africa, and the action required to motivate Government to deliver it’s obligatory service instead of failing such service and receiving Value Added Tax as a direct result of such failure. In this regard STAND and PRIORA FORUM are working closely with the Free Market Foundation, the Law Review Project, and a number of organisations that each contributes their unique skill in order to ensure the success of this initiative. This strategy involves bringing an application before the High Court of South Africa in order to gain access to the Constitutional Court, and the preparation of the correct Constitutional procedure to motivate our case successfully.

The cost of this initiative is so well explained in a letter from Mr Leon Louw of the Free Market Foundation, that I am going to quote from it as follows:

1.  “The zero cost option is where civilians handle the case themselves. Except in rare cases the zero cost option is unlikely to succeed.”

2.   “The medium cost option would be an attorney and a junior counsel (knowledgeable about constitutional law) at regular rates.”

3.   “The Rolls-Royce option would be using top attorneys and multiple junior and senior counsel who are leaders in the field. This option could cost as much as R1 000 000,00.”

If we were allowed to utilise Option 3, the following prominent lawyers would be approached for their services to assist in this preparation:

Adv. Hamilton Maenetje –  specialising in constitutional law.

Adv Norman Davis – junior counsel who is particularly sound on theoretical and conceptual issues.

Attorney Tony Richard – a passionate believer in the constitution and its proper enforcement and interpretation.

Prof Vincent Nmehielle – Prof of Constitutional Law at Wits and on the Law Review Project Board.

Adv Gilbert Marcus SC –  most highly respected constitutional lawyer.

Adv Prof David Unterhalter SC – most highly respected constitutional lawyer.

Gary Moore – partner at one of the big 5 law firms.

Adv Nicholas Tee – junior counsel on the Jhb bar, highly conversant with the constitution and our way of thinking.

...and any other expert that might come to mind while we are preparing this case.

Project 10 000 x 100 thus needs 10 000 South Africans to each contribute R100 once off to the Trust Fund - details given below. (Any contribution is welcome though.) STAND and PRIORA FORUM invite all thinking South Africans to direct any questions in this regard to the contact details provided. After 10 years of constitutional democracy, it is time for all South Africans to become actively involved in this positive, business-like effort to motivate Government to render the service to it’s citizens as demanded by the constitution, which is to improve our quality of life by PREVENTING crime. It is possibly the last and only real recourse that we, as citizens, have. Petitions, protests, letters, voting and talking have certainly not worked. Simply observe the crime statistics over a period of time! Then ask yourself the simple question: Do we deserve such treatment, with the “best constitution in the world” and while “paying” government all sorts of taxes to make this Constitution a reality for us and our fellow law abiding South Africans? And the worst part is, if Government fails to honour their obligation in terms of the very same constitution, which it does dismally, we pay them 14% of our expenses as a direct result of their failure? Why?

STAND and PRIORA FORUM are taking the lead in addressing these issues with Government, but we can only do so with the support of all the people of South Africa.
